Terms of Use

1. Definitions

• Administrator: SmartLink Auto, the operator of the Site.
• Agreement: these Terms of Use, governing the relationship between the Administrator and Users and establishing the rules for using the Site, including all Content, the conditions for receiving services, and the procedure for obtaining vehicle reports.
• User: a natural person who uses the Site, whether by browsing pages or by using any of its services or functionality.
• Content: the informational content of the Site, including text, images, photographs, illustrations, logos, hyperlinks, audio/video works, design elements, software, files, and any other works, objects and materials placed on the Site by the Administrator.
• User Data: information about the User provided when submitting a request on the Site (for example, when using the VIN search, ordering a report, or contacting support).
• Site: the Internet resource owned by the Administrator at https://kautocheck.com/, including all software, design, Content, subsections, and any information published by the Administrator.
• Services: any functions and/or features of the Site, whether free of charge or paid, including the VIN lookup, vehicle history reports, directory of trusted sellers, and any other services that may be added in the future.
• Vehicle (Korean Vehicle): a vehicle assembled in South Korea, or assembled elsewhere and exported to South Korea, or imported from South Korea to any other country, i.e. any vehicle ever operated in the territory of South Korea.
• VIN: the Vehicle Identification Number.
• Free Report: information about a vehicle returned via the free VIN lookup on the Site, which may include the model name, colour, date of export from South Korea, the start of the vehicle’s operational history, mileage at the time of export, and photos.

2. General Provisions

2.1. This Agreement establishes the rules and conditions for the use of the materials and services of the Site and constitutes an agreement between the User and the Administrator.

2.2. Access to the Site, use of the Site, and/or any other action on the Site means that the User accepts and agrees to comply with all the terms of this Agreement without reservations or exceptions. If the User does not agree, they must immediately stop using the Site.

2.3. The Administrator reserves the right to modify, add, or remove provisions of this Agreement at any time without separate notice. The updated version takes effect from the moment it is posted on the Site. The User is responsible for reviewing the current version from time to time. Continued use of the Site after the updated version has been posted constitutes acceptance of the updated Agreement.

2.4. The use of the Site is offered on an “as is” basis, in the form and to the extent in which the Administrator provides the functionality at the moment of access.

2.5. The Administrator is not liable for temporary interruptions or failures of the Site for technical reasons, external threats or cyber-attacks, nor for any indirect, incidental or consequential damages, loss of profit, or harm to honour, dignity or business reputation caused in connection with the use of the Site.

3. Subject of the Agreement

3.1. The Administrator provides the User with the ability to perform a free VIN-based search for information about Korean vehicles through the VIN search section on the Site.

3.2. A User request is made as follows: the User opens the Site, enters a VIN in the search field, and presses the “Check” button.

3.3. As a result of the free search, the User is shown a Free Report intended for personal, non-commercial use. The Free Report may include: model name, colour, date of export from South Korea, the start of the operational history, mileage at export, and photos of the vehicle.

3.4. In the course of providing the service, the Administrator collects information from sources made available by its partners or from other sources to which it has access, including data from the Korean Ministry of Land, Infrastructure and Transport and data from auction and marketplace platforms.

3.5. In addition to the Free Report, the Administrator may offer paid vehicle history reports with extended information (mileage timeline, risk score, export dates, documents, PDF). Payment for such reports is processed by third-party payment providers. Details and pricing are displayed on the Site at the time of purchase.

3.6. The Administrator does not guarantee the completeness or accuracy of the information in the Free Report or paid reports, and is not liable for the timeliness, reliability or completeness of such information (see Section 6).

4. User Obligations

4.1. The User agrees not to take any action that may be considered a violation of applicable law or international norms, including in the field of intellectual property, copyright and related rights, nor any action that disrupts or may disrupt the normal operation of the Site or its services.

4.2. The materials and services available to the User may be used exclusively for the purposes for which they are intended. The User is prohibited from using any information obtained on the Site (including the Free Report, paid reports, and cost calculations) for any purpose other than personal use, and from transferring such information to third parties or publishing it on any publicly accessible platforms, websites, messengers or print media.

4.3. The User undertakes not to:

• take actions that could cause a disproportionate load on the Site;
• upload or use malware on the Site;
• interfere with the normal operation of the Site or attempt to circumvent automated systems or access controls;
• copy, reproduce, modify, distribute, or make publicly available any information on the Site (other than information provided by the User themselves) without the Administrator’s prior written consent;
• use automated scripts or scrapers to collect information from the Site.

4.4. The User is solely responsible for the content of messages sent through the Site, including via any contact forms, chat bots, channels or messengers associated with it. The User agrees not to upload, publish or distribute any content that is:

• unlawful, threatening, abusive, defamatory, misleading, fraudulent, invasive of privacy, harmful, or sexually explicit;
• harassing or demeaning towards any person or group on the basis of religion, gender, sexual orientation, race, ethnicity, age or health;
• infringing on any patent, trademark, trade secret, copyright or other right;
• unsolicited or unauthorised advertising, spam, chain letters, lotteries or gambling;
• containing viruses or other code designed to damage or interfere with software, hardware or telecommunications equipment, or to gain unauthorised access to data;
• impersonating another person or entity, including any employee or representative of the Administrator.

4.5. The Administrator is not responsible for the content of any materials uploaded or sent by Users. The Administrator generally does not review or edit User-submitted content but reserves the right, at its sole discretion, to remove any content that, in its opinion, does not comply with this Agreement or is harmful, undesirable, or incorrect. The Administrator may also terminate a User’s access to the Site in the event of a breach of this Agreement.

5. Intellectual Property

5.1. Exclusive rights to the software, databases, design elements, trademarks/logos and other identifiers of the Administrator, as well as all Content on the Site, belong to the Administrator and are protected under applicable copyright law.

5.2. No materials, files or services on the Site may be reproduced, in whole or in part, in any form or by any means, without the prior written consent of the Administrator, except as provided in this Agreement. When reproducing Content with permission, the User must include a clear attribution link to the Site; the link must not contain false, misleading or derogatory information. Translation, modification, or removal of copyright notices is not permitted.

5.3. Any trademarks, service marks, logos and emblems of third parties that appear on the Site are the intellectual property of their respective owners. The User may not reproduce or otherwise use such marks without prior written permission from the relevant owner.

6. Liability

6.1. The User is responsible for actions performed on the Site, including the content of any information posted.

6.2. For breach of this Agreement, the parties bear liability in accordance with applicable law.

6.3. The Administrator is not liable for the timeliness, completeness or accuracy of information received or provided by partners and third parties, including the Korean Ministry of Land, Infrastructure and Transport, auction platforms, and vehicle marketplaces.

6.4. The Administrator is not liable for loss or corruption of information by the User when using the Site, for damages caused by measures taken to prevent violations (including temporary blocking of access), or for the use (lawful or otherwise) by third parties of information obtained by the User from the Site.

6.5. The Administrator is not liable for failure to perform obligations due to force majeure.

6.6. In the event that third parties bring claims against the Administrator in connection with a User’s breach of this Agreement, the User undertakes to resolve such claims independently and to reimburse the Administrator for all losses incurred, including fines, legal fees and compensation.

6.7. All information on the Site is provided on an “as is” basis, without any warranty, express or implied. To the extent permitted by law, the Administrator disclaims all liability, express or implied, including implied warranties of fitness for a particular purpose and legality of any information, product or service obtained through the Site.

6.8. The Administrator does not guarantee that the Free Report or any paid report contains all listed fields about the vehicle. In particular:

• information about mileage may be missing; where both text and photographs are available, the text data should be relied upon rather than the mileage visible in the photos;
• information about the export date may be missing, the User may contact the Administrator for clarification;
• data about export may be absent, the Administrator may ask the User to verify the correctness of the VIN;
• the vehicle colour in the report may differ from the User’s expectation because Korean documents record colour according to manufacturer data (for example, “ivory shade” may be recorded as “white” on import). Such shade differences are not considered errors;
• the report may contain a note stating that the vehicle was “totalled”. This indicates that the vehicle was in a road accident and that the insurer paid out the full value of the vehicle (equivalent to a “total loss” determination).

6.9. The Administrator reserves the right to update information on the Site. The information about a given vehicle may change between checks due to corrections or updated source data. The initial report is not considered inaccurate, and the service is deemed to have been rendered properly.

7. Third-Party Resources and External Links

7.1. The Site may contain links to other services of the Administrator and to third-party websites. The Administrator does not control and is not responsible for the availability, content, accuracy, reliability, completeness or legality of third-party resources, nor for any transactions between the User and third-party providers of products or services.

7.2. The presence of a link does not constitute endorsement of the third party or any warranty in respect of it. Any such link is provided solely for convenience.

7.3. Without the Administrator’s consent, it is prohibited to use technical means to interact with the services of the Site outside the ordinary course of use of the Site, including the use of automated scripts to collect information.

8. Cookies

8.1. The Site uses cookies, small text files placed on the User’s device when visiting websites. Cookies are used to ensure the effective and secure operation of the Site and to improve the user experience. Session cookies are stored until the User leaves the site; persistent cookies remain after the session ends.

8.2. The User may refuse cookies or delete them via the browser settings. Some features of the Site may not work correctly without cookies.

8.3. The Site may use analytics tools that help us understand how visitors use the Site. Data collected by such tools is used in aggregated form and does not, by itself, identify individual users.

9. International Use

9.1. The Site may be accessible worldwide, but the Administrator does not guarantee that its materials are suitable or available for use outside the jurisdiction in which the Administrator is established. Access from places where the content is unlawful is prohibited. Users accessing the Site from other locations do so on their own initiative and are responsible for compliance with local law. Any offer of a product, service or information made in connection with the Site automatically ceases to be valid where it violates local law.

10. Final Provisions

10.1. This Agreement is freely available on the Site. Its provisions apply to all Users regardless of registration or authorisation. Any form of interaction with the Site (including simply viewing information) confirms the User’s acceptance of the Agreement.

10.2. This Agreement is concluded for an indefinite period and applies to Users from the moment they begin using the Site.

10.3. For any questions, notices, proposals or complaints concerning the Site, the User may contact the Administrator by email at support@kautocheck.com.

10.4. Headings in this Agreement are provided for convenience and do not affect the interpretation of its provisions.

10.5. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The Administrator undertakes to replace any such provision with a valid one that most closely reflects the intent of the original.

10.6. Any disputes shall be resolved through negotiation. If the parties fail to reach agreement, disputes shall be resolved in the court of competent jurisdiction at the location of the Administrator, in accordance with applicable law.
